Administrative Court Reform 

Administrative judicial cases, which involve complaints against the government, are often susceptible to corruption, as they tend to be complex and poorly understood. The Administrative Courts Component of the MCC Albania Threshold Program II will support the creation of a system of specialized administrative courts to adjudicate these disputes. These courts will increase the confidence amongst the Albanian and internaltional business community and help protect the rights and interests of all Albanian citizens.

MCCA2’s Administrative Courts Component works to achieve the following results:

Administrative Courts management procedures established. The program is committed to drafting the secondary legislation and
regulations for the administrative courts (ACs), which provide guidance on the new administrative justice legal framework for judges, state and private attorneys, as well as public officials.

Court management software developed and installed. A key initiative of the program is the development of an IT system to manage the ACs’ case flow with a web-accessible public information portal, including online access to court decisions.

Administrative judges, attorneys, and civil servants trained. Working with the School of Magistrates, the Albanian Bar Association, and the Training Institute for Public Administration, MCCA2 will train judges, state and private attorneys, and public officials on the ACs legal framework and processes.

Public informed and trust in judicial system improved. As the ACs law is approved and implemented, the program will establish information kiosks and conduct a country-wide public information campaign to educate businesses and the public at large about the ACs system scope and operations. The program will support nonprofit organizations’ monitoring of the ACs’ proceedings and public access.

 Increase judicial capacity, reduce opportunities for corruption and build investor confidence by supporting the administrative court system 
 An independent administrative court in full operation
 Case management efficiency increased, average time to resolution reduced by two-thirds to 30 days

 ACCOMPLISHMENTS

 Draft administrative courts law. MCCA2 actively contributed to the final version of the draft law and bridged divisions between the many disparate groups engaged in the drafting process. Largely as a result of an intense advocacy campaign conducted by business associations and civil society organizations — with MCCA2 support — the draft law now has broad support.
 Creating a case management system. At the end of Year 1, MCCA2 succeded in developing a considerable portion of the new case management system (CMS) for the administrative courts (which will automate manual processes and ensure that court procedures are efficient and effective), including modules to cover the majority of the case flow within first-instance courts.
 Developing training courses. Working closely with international and Albanian experts, MCCA2 began to develop ten courses to train the judges and staff of the future administrative courts (along with lawyers that will work with these courts).

The application process for membership in the Tax Council begins

By September 23, 2010, chambers of commerce and industry, business associations, professional associations of accountants and accounting experts, other professional associations established by special law, as well as other non-profit organizations that represent large taxpayers’ groups would be able to submit at the Ministry of Finance their applications for membership in the Tax Council.

Established based on an April 2010 amendment of the law “On Tax Procedures in the Republic of Albania”, with support by MCCA2, this Council serves as a consultative body and a technical cooperation forum between the Ministry of Finance, General Directorate of Taxation, and taxpayers. Its purpose is to discuss and propose measures to ensure implementation of the tax legislation at a lower administrative cost for the tax administration and lower financial burden for the taxpayers.
