| Administrative Court Reform |
|
Administrative judicial cases, which involve complaints against the government, are often susceptible to corruption, as they tend to be complex and poorly understood. The Administrative Court Component of the Millennium Challenge Corporation (MCC) Albania Threshold Program II will support the creation of a specialized tribunal to adjudicate administrative disputes. It aims to strengthen confidence among the business community in the Albanian justice system, and enable the civil society and the private sector to monitor effectively the administrative court.
The program’s Administrative Court Component works to achieve the following results:
Administrative Court management procedures established. Once the Law on the Administrative Court is enacted, the program will develop the secondary legislation and regulations that provide guidance on the new legal framework for judges, state and private attorneys, as well as public officials.
Court management software developed and installed. The program will develop an IT system to manage the court’s case flow. It will have a web-accessible public information portal, including online access to court decisions.
Administrative judges, attorneys, and civil servants trained. Working with the School of Magistrates, the Albanian Bar Association, and the Training Institute for Public Administration, the program will train judges, state and private attorneys, as well as public officials on the legal framework and processes related to the administrative court.
Public informed and trust in judicial system improved. The Program will establish information kiosks at the court and conduct a country-wide public information campaign to educate businesses and the public at large about the court’s scope and operations. The program will support nonprofit organizations’ monitoring of the court’s proceedings and public access.
The outcomes of the project's engagement as regards the administrative justice include:
• The new Law on Administrative Court authorizes the establishment of the court. • A state-of-the-art electronic court management system is put in place to administer the court’s case flow. • About 500 judges, state and private attorneys, as well as public officials, are trained on the administrative courts’ procedures. • The business community and the public at large become well informed on the administrative court’s scope and processes. • Court monitoring mechanisms that enable citizens’ oversight are established.
